One of the most frequently asked questions by employers in Malaysia intending to hire a maid is ‘can the maid live outside/away from my house?’ As an established maid agency in Malaysia, it is our duty to advise our clients accordingly to adhere to the rules and guidelines that govern employer-maid relationship in Malaysia.

So… Can your maid live outside of your residence?

No, it is not permitted for maids in Malaysia to “live out.” Employers are required to offer “suitable accommodation” in their homes for their maids.

In the contract of employment between the employer and the maid, it is stipulated in Clause 2 and 4(a) that it is the employer’s obligation and responsibility to provide the maid with basic accommodation during her employment. Clause 2 of the contract requires the employer to confirm the residing address of the maid. Not obliging to these pre-agreed conditions will amount to a breach of contract by the employer, and the maid will have the rights to demand compensation.

Reasons Behind The Live-In Requirement

  1. Security and Accountability: The live-in requirement allows employers to supervise their maids and ensure their safety and well-being. It minimizes the risk of domestic workers being exploited by unscrupulous third parties or becoming involved in unlawful activities.
  2. Work Permit Conditions: The work permit issued to foreign domestic workers in Malaysia explicitly states that they must reside with the employer. Violating this condition can result in penalties, including the revocation of the maid’s work permit or fines imposed on the employer.
  3. Compliance with Immigration Law: Since the maid’s work permit is issued for the specific purpose of domestic work within a particular household, living out is considered a violation of immigration law. Both the employer and the maid are subject to strict compliance to avoid legal repercussions.

Alternative Arrangement

While live-out arrangements are not allowed for foreign domestic workers in Malaysia, there are other options available if live-in help doesn’t suit your needs:

Part-Time Domestic Workers: You can hire a part-time or local domestic worker who is not bound by the same immigration laws as foreign workers. This gives you flexibility in terms of hours and living arrangements, but it often comes at a higher hourly rate.

In Malaysia, it is important to understand that foreign maids are legally required to live in the employer’s home.
